Posted By Dave B We had to remove and replace part of a ceiling in a domestic property due to flooding. The ceiling was coated with artex (ACM unknown) on to plasterboard (non ACM).
The work was carried out as if the artex was an ACM but the question arises about whether the removed part of the ceiling should be treated as special waste and subject to waste transfer notes and licenced transporters etc. The artex was not stripped from the plasterboard.
On a previous enquiry to the Environment Agency it was suggested that unless the asbestos content was > 0.1 w/w of the total waste then it was not to be considered special waste.
Your comments would be very much appreciated.

it would be classed as Hazardous Waste under Haz Waste Regs 05 if the % of asbestos is greater than 1% WW/Volume.
Now the question is, as the asbestos content is very low, % wise in relation to the overall weight of the waste, it is up to you to decide whether it falls within the scope of less than 1%.
we have contacted both the HSE & EA on this and 'off the record' it is not Haz Waste.
The Asbestos Licensing Group met last month and have been discussing this for about a year now since the introduction of CAR06, In this meeting the ALU from the HSE have been given an action to produce an ALG Memo on when this type of waste can be reused or recycled etc, this is due in the next couple of months.
Not much help at the moment but that where we are with this.

The old special waste regs refer to a limit of 0.1 % w/w volume. Have the 05 regs changed that?? I can't see it anywhere.
