As a social landlord, when selling a property we have a duty to pass on information regarding asbestos etc.

However, there isn't anything in the regulatory fire reform about passing on fire info is there?

(i'm being vague as i'm waiting specifically to see what they are requesting) but thought I would ask in the mean time.

Had a bit more information about this.

Basically the solicitor is referring to Article 31 (1) of the fire safety order.

But this refers to enforcing authorities and says that if the enforcing authority is of the opinion that use of a premises involves or will involve a risk to relevant persons etc etc (and in this article premises includes domestic).

But this statement is for the fire enforcing authority isn't it?

There is no legal duty to carry out any fire assessment on our residential properties (houses) for tenants is there and then for it to be passed on when the property is sold?

Brenda,

Whilst you have control of your properties you have duties to pass on information to other people in specified circumstances. See HS(M)R 1999, CAR 2006 and RR(FS)O 2005.

In selling your properties you do not have to provide information regarding fire, asbestos etc unless requested. However, you have a duty to ensure that any information provided is accurate and not misleading.

Sorry, going to sound ignorant here, but what would we provide in relation to fire, especially when we didn't build the property and haven't done a fire RA as it's not a workplace?
