Hi

I am looking to find some decent case law on Hand Arm Vibration problems.

Has anyone got any suggestions on key case law or the best place to get a good list - the web comes in with either nothing or too much and I am struggling a little to see the wood for the trees.

Try this for starters:

Transco PLC v David Charles Grigg [2003] EWCA Civ 564. The case was dimissed by the Court of Appeal.

Rhesa Shipping SA v Edmunds, The Popi M [1985] 1 WLR 948

Burke v McCaffery & Ors v Glasgow City Council [2005] Scotcs CSOH 155. Case held (won).

Hague v Rexam Glass (Barnsley) Ltd [2006] EWCA Civ 377. Case dismissed.

Mr D. Williams [2001] UKSSCSC CI 2238 (Vibration White Finger)

Google them and it should come up with something.

Great help, anyone got any more. Also any tips on how to get case law in a reasonable level of detail and where to go for it would help

Most providers of case law information charge for their services. However, Bailii is a useful web site for case law, although the full case will be provided and it is a bit heavy going if you are not used to the lingo.

Case: Mustoe v Saunders Valve Company (1979)Awarded general damages of £1,250 + £750.

Case: Heal v Garingtons Lts (1982)
Laid down a tariff for VWf. Stage 1 £500, Stage 2 £1,000, Stage 3 £3,000.

Case: Bristol Coal (1997)
Seven former minors awarded a total of c £125,000.

Case: British Gas (1998)
Awarded six gas fitters a total of c £430,000

Case: British Rail (1998)
Awarded four former engineering workers a total of £35,000.
