Dear all,
Ok, so a guy falls at work due to a wet floor on a Thursday, he is off sick as a result on the Friday & the Monday.
The Saturday & Sunday are his days off so in effect he has been off sick 2 days, right?
The Regs as I see it state days off either booked holidays or rota days off should count - so this means the guy has been off work 4 days
This makes this incident reportable under the over 3-day section?
Am I right or wrong on this one?

Unable to perform his normal duties is the criteria, so yes you are right.

Have you interviewed the guy? Was he fit to undertake his normal duties on either Sat or Sun?
If interviewed and he confirms that if he had been required to work and he was indeed fit to do so it is not reportable incident.

Criteria is not just being unable to do the full range of their normal duty for more than three days. It also includes the fact that they are absent from work for more than three days including Sat and Sun.
In this particular case it is clear that the person was unable to do the full range of duties by their continued absence on the Monday.
Therefore reportable under RIDDOR.
