If we provide an area for drivers to use during rest breaks is there a "legal requirement" to provide them with boilding water for tea/coffee??
If so where is it stated?

Any help will be much appriciated

Are facilities readily available else where (e.g. Local cafe etc) or are you working on an industrial estate etc or times where such facilities are not easily accessed?

Have a look at regulation 25 - (Facilities for rest and eat meals) workplace health, safety and welfare regs . And the associated ACOP. If you provide such facilities because not available else where then yes you need a kettle.

If its just a break while waiting for a wagon to be unloaded and there's a local cafe then no just Drinking water (reg 22)

Hope that makes sense answered in a bit of a rush.

Check the Workplace H,S & W regs and HSE Guidance INDG244

Quote from guidance :
"Where provided, eating facilities should include a facility for preparing or obtaining a hot drink. Where hot food cannot be obtained in or reasonably near to the workplace, workers may need to be provided with a means for heating their own food (eg microwave oven)."

You can get the guideance at :

If its on a construction site CDM 2007 would apply and there is an inclusion in Schedule 2for the facility to heat food and water for drinks.
