Posted By Patrick Canning Hi all can anyone enlighten me, is top soil waste, i'm moving top soil from one of our sites onto another and i'm getting different reports from EHSNI. Do i need to have an exemption cert. to hold the top soil, i've also been told that i cant hold top soil on the other site for more than 3 months?????? WHAT??? Help!!!

Posted By Bob Youel If a substance/preparation or a natural compound etc is not waste e.g. its to be used again; then its not waste so the waste parameters do not apply A none waste substance and / or a waste substance etc can still be 'hazardous'

Posted By Mitch Patrick, As long as it's not contaminated assess as hardscaping material and treat, transport, store, as any other non-hazardous material I am sure that no agency could disagree with that, though they may insist on a sample analysis. Mitch

Posted By CFT Patrick Is this for localised re-use and if so what final purpose? If not is this for disposal purposes? What is the quantity? What is the quality? (test results) Have you detailed information by way of soil contamination analysis? In a nut shell it is not as simple as you may first think; it would be helpful to know what the cubic tonnage is. In England, Scotland and Wales, the stripping and removal of topsoil is subject to various controls. You may require planning permission and other related permissions (quantity is key); your 3 months may be making reference to removal of more than five cubic yards of surface soil from agricultural land in any three-month period. Could you supply any more background and on any desk studies you may have for a more accurate response? CFT

Posted By Patrick Canning CFT This is non contaminated top soil. We are taking it from one of our sites and placing it on another site of ours, in about 2 years time we will use it to fill gardens after we builb new houses. There will be around 300tonne, all of it will be reused. Patrick
