Posted By DaveCole Morning All I have been looking at the legislation for HGV drivers with regards to the wearing of seat belts.(do they or don't they have to)We have vehicles in and out all day and have a breach system for reporting certain things. I am inundated with reports of HGV drivers not wearing seat belts. Seems to be that lots of places say different things. Anybody know the official stance or point me in a direction to find the definitive answer Thanks in advance. Dave C

Posted By ClaireL Unless the law has changed in recent years they are not required to wear setbelts. However, someone feel free to correct me if the law has changed in recent years as it would be useful to know!

Posted By Stupendous Man I thought that everyone had to wear a set belt (unless exempted medically), apart from drivers undertaking multi-drop work (such as milkmen, postal workers etc). Anyone else?...

Posted By ClaireL ...actually I'm not quite as out of date as I thought. I should have looked at the date on the article more carefully. The Directive was 2003 but it sounds like it wasn't implmented into our laws until May 2006! Hopefully that's right this time!

Posted By John Portt Having read the above article it mentions seat belt to be worn where fitted, does this mean if the lorry does not have them fitted you dont have to wear one or get them fitted into your lorry

Posted By RP where they are fitted, they must be used: This is the hangover from where they may not have been fitted to older vehicles. These days they are fitted as standard. You would need to apply for an exemption order not to wear them. The 50 metre figure relates to postal workers and refuse collection in the main, where if the organisation has been granted an exemption then it only applies to the organisation and not the whole of the UK LGV driver group. Look at DVLA and VOSA websites for more... If a driver chooses not to wear a seatbelt, then they commit the offence and not the employer.
