If a road is a structure along with drains and structures that alter any natural features e.g. embankments and are subject to CDM Regs then what of the design, planting and maintenance of the verges. Are they also subject to this widely influencing legislation or does it become irrelevant after the completion of the construction phase?

Good Question

I often quiz the spirit of CDM and general requirements due to the fact that the CDM regs appear to suit a big "Wembley Stadium" and leave the more obscure projects out on a limb. For example, I am reliably informed that SWMPS need to be more detailed if the project costs more than 500 grand. That is all well and good but in my case the cost of our project does not necessarily mean more waste. It could be that the cost is in relation to the expense of a particular piece of kit or a new technology.
Likewise a project that lasts 6 weeks does not necessarily become notifiiable, I have witnessed certain parties altering the programme to suit.
In answert to your question always err on the side of caution and introduce the CDM concept as an integral part of your project. You probably do anyway.

Hi Iain,
The latest CDM ACoP L144 states that "Tree planting and general horticultural work" are not classed as construction.

Working on the fabric of the highway would be classed as woring on a structure and CDM would apply where the work in notifiable.

The planting/maintenance, etc of highway verges and landscaped areas are not covered under CDM, as stated above.

But, designers/planners beware that the Management of Health, Safety and Welfare does apply. Here such planting, etc needs to consider the on-going maintenance issues to ensure that it can be done as safely as possible.

From the Designer's perspective Iain, I think the answer is yes!
In the same way that the design of glazing on a building has to consider how it may be accessed and cleaned, so with the bankings.
Somewhere in the Project, someone will decide the profile of the banking and the planting regime - correct that relative risks be considered and recorded.
