Hi all,
Your helps is greatly needed.
Scope: Resident at a residential scheme aged 88 was making her way to the communal toilet. On the way there she fell in the corridor and fractured her hip. Paramedics called, she remained in hosp for more than 24 hours. No slip/trip hazard at the scene of the accident.The fall was more to do with a loss of balance because of her age and mobility issue.
Question: Is it Reportable?
I have phoned the HSE info line on a few occasions. Getting mixed messages from them. Not best pleased lol
My View: NOT REPORTABLE, as the fall was not a was result of an act or omission on our part, neither was their a failure to cause the accident.
Whats your view on it?
Here's the email response i got from the manager at HSE contact centre.
"I understand that you contacted the Incident Contact Centre earlier today regarding a slip / trip incident to a non-employee where there were no trip hazards or problems with the floor. If the injured person was not taken from the scene of the accident to hospital then it would not need to be reported under the RIDDOR Regulations. The Guidance to the Regulations states:
45 Any injury to a person who is not at work (eg a hotel or care home resident, pupil or student, or a customer in a shop) must be reported if it:
(a) results from an accident arising out of or in connection with work: and
(b) results in them being taken from the premises where the accident occurred to a hospital, by whatever means (for example by taxi, private car or ambulance). "
46 .....There is no requirement to check that treatment is actually administered by the hospital. The injury must still be reported in cases where the person does not receive treatment.
Is it me or are the paragraphs above contradictory? Also there is no mentioned of 24 stay at hospital. The answer suggests anyone admitted to hospital as a result of an accident at work is reportable????
Your thoughts please. Is the case i described above reportable? As i mentioned, i would say NO.

Hi,
By the letter of the Regs I would say no, but if this had occurred in hospital then it could be a yes as the adequacy of nursing care/supervision might be called in to question. Are carers on site to assist the residents, if so how is the level of such assistance decided, is a risk assessment/personal care plan system in place?

Hi Abs,
I'd always understood that 24 hour in hospital refers to employees and third parties if taken to hospital - where reportable.
If a medical condition major injury and/or taken to hospital it's not RIDDOR as you've said its not by act or omission.
I don't report any major injuries or hospital admissions when its a medical condition cause (otherwise we would have quite a few!)

Abs,
I suspect it all rides on the definition of "residential care scheme".
As I understand it there are different definitions for residential homes, care homes and nursing homes.
Some would be reportable and some wouldn't, depending on the nature and level of care given (i.e. is someone at work?).
Also RIDDOR states that if a member of the public is taken to hospital from a "place of work" then it is reportable as a major injury.
...That's my current understanding anyway.
