Is it a legal requirement (written) or just best practice when driving FLT on public highways to leave the forks in an up position?

Hi,
As I understand it (and see previous IOSH postings) if the FLT will travel more than 1000 metres on a public road it must comply with Construction and Use Regs. If less than 1000 metres e.g. between sites or unloading there is special dispensation with these Regs and in most cases it can be driven with little modification but it must be registered and insured (see http://aes-training.com/2k5/fltroaduse.php for info.) When travelling unladen forks should be removed, folded back or fitted with marker plates which should be illuminated sunset to sunrise and similar action with attachments. If laden the load should not project more than 2 metres, there should be clear forward vision. Its also recommended that road signs are used to warn the public of FLT use on the road.
