Under CDM 2007 - where the Client appoints a Principal Contractor on a Design & Build project, clearly the PC will be responsible under the regs. to appoint the designer (in this case they are HVAC/Elec/Plumbing Designers) However, in this case the Client has a clear and well established approved list system, enhanced by its own Health and Safety Passport System for all persons inc. designers and workers/visitors to site etc, based on CDM 2007 competency guidelines. Must (or should?) the Client be approving the designer proposed by the PC? and indeed would it be wise? We think so, the PC thinks otherwise. Any comments from members out there would be appreciated to help cut through the fog a bit. Thanks Sue.

As its the 'clients' site and you are there at his bequest, he can ask what he wants. However, it should be the CDM-C that offers guidance to the client on the competency of the 'designer' in order for them to fulfil their obligations under CDM.
Check out the ACoP and this will tell you what you need to confirm re competency, but generally it is experience, trained, qualified etc...... but they must take account 'as far as is reasonably practicable' that the construction works is to safely constructed and maintained, without imposing risk to those likely to undertake the works. There will be consultation between CDM-C, PC & Designers, and the development of the Construction Phase H&S Plan obviously to present to the client.
