If a breach of the HSAWA happened prior to the Health and Safety (Offences)Act 2008 coming into force in January 09, but the charges are brought to court after the new legislation would I be right in thinking that the fines would be based on the old powers of the courts at the time of the offence?

Advice would be appreciated.
