Hi Guys
I would like your thoughts on the following scenario:
Multi Tenanted Office Building over six (6) floors, with four (4) dedicated Fire Escape Stairs all fitted with Disable Refuge with intercom & alarm on all levels linked directly to the reception desk (This can be used remotely away from the desk)
Here is the thing, who is responsible for the evacuation of disabled persons from the building i.e. disabled/mobility impaired employees or visitors of the tenants?
The Landlord has no directly employed staff onsite or disabled/mobility impaired persons (All contractors and able bodied)
I have been informed by the local Brigade that they will not evacuate disabled/mobility impaired persons from the Refuge Points, they have told me that it is Landlords responsibility and that the Landlord should (Not “must”, but the word should was used) provide evacuation chairs and training for the onsite contractors to evacuate any disabled/mobility impaired persons from the Refuge Points to the Assembly Point. As this is the Landlord responsibility.
My opinion that this is the responsibility of the tenant as it is their employees or visitors and they must prepare their own Personal Emergency Evacuation Plan (PEEP) which if I remember correctly it should be a plan which enables the evacuation of a disabled/mobility impaired persons directly to a place of “Ultimate Safety” (Their Plan they should implement and practice this)
Currently there are no disabled/mobility impaired persons that work at this building but they still state we should provide this “service”.
Apart from this they thought the building was great. Happy Days

It seems inconceivable that the brigade turn up to a burning building, you tell them there is a disabled person in the refuge and they say 'no we're not getting them out, that's the landlords responsibility'.
What are they going to do? Let them fry?

After a Dynamic Risk Assessment, they would undertake a rescue not an evacuation forgot to mention that.
Bum covering phrase in case they injure that "said" disabled person "Rescue" OK "Evacuation" = "Compy"
But the landlord can place their contractors at risk by allowing them to Evacuate "Said" Disabled Person.
It is a sad Ambulance Chasing Culture we live in.
Clairel hit the nail on the head with her thread "Have we gone too far" and we have when good fire fighters have to think of this "Where there is blame there is a claim" culture everytime they go to a shout.
That said I still believe it is the employers responsibility for the safety and welfare of their staff and visitors
