The Health and Safety (Consultation with Employees) Regulations 1996

The Health and Safety (Consultation with Employees) Regulations 1996 says that the elected health and safety representative must be employed in the group that elects them.
My question is what classes as a group is it each department or each department different shift i.e. Shipping 1st, Shipping 2nd?

I take the view that it is the department in which they are working. I am currently going through the same process of trying to assemble a group of RoES. We have a situation where there are a number of different shift patterns. In one area the shift working pattern is 4 on 4 off alternative days and nights with about a dozen people on each shift. In this instance shifts 1 and 2 will elect a representative to cover both shifts as will shifts 3 and 4. I reckon this will work because there is a cross over period between each shift to allow for shift changeover issues.
In another area there is day and evening shift working. In this instance I want each shift to elect their own representative because of the larger numbers of people involved.

This is not prescribed. Para 120 of L146 (2008)provides further guidance. You choose! You can also choose the time between elections and agree additional functions for RoES.
Most importantly, consider & provide the training these people will need to enable them to carry out their functions effectively.
The above reply does not apply to Offshore Installations, where much more prescriptive legislation applies.
