Was the driver in control?

The dock door was closed and the dock control light was set to green meaning the vehicle was free to move however the incident was bought to my attention due to the fact that the HGV moved without the driver having the keys.

I was under the wrongful impression that the vehicle would not move with the engine switched off but I have been told that it will as long as there is air in the system but once gone the brakes lock on. With the engine not running means that the wheel lock will come on as it does in cars so the HGV.

I don’t believe that you could class the driver as in full control of the vehicle but would like to know what the thoughts are on this.

When you say the lorry moved, you give no indication of how much distance etc,you can be under full control if you are just rolling forward a few feet, something the driver might have done even if he did have the keys, without the engine running however the power steering would not work making it nearly impossible to steer the vehicle, also if the brake pedal was pressed a few times without the engine running,stored air in the tanks would be used up resulting in the parking brakes activating automatically. from the information posted i would say the driver was in complete control

Bear in mind that some drivers a known to keep a second key. many don't like the fact that they have to have over the keys when loading.
