Whilst fully understanding the need to undertake surveys of property, and the logical conclusion that such surveys should be undertaken by a competent person, struggling to find actual legislation that prescribes such surveys and specifies the level of qualification required to be deemed competent. Can anyone point me in the direction.

Can you expand on what you mean when you say 'survey'? For example, is it to do with the condition of the building itself, compliance with the Workplace Regs etc?

Depending on the age of the building, an asbestos survey may be required.

Control of Asbestos Regulations 2006.
Regulation 4, "The Duty to Manage"

if its an environmental survey you need a person who is competent re environmental areas and so on; so the term 'condition survey' needs to be clearly defined and thereafter you get the right persons in

Hi Paul

The source of legislation & Guidance will depend very much on WHY the survey is being conducted.

Assuming that you're UK based, Possible root sources could be:-
H&S - Workplace Regs;
Fire - FSO & Home Office Guidance;
Structural stability & Planning compliance - Building Regs & associated Approved Documents.
Environmental - various Regs & Guidance, mostly available from the EA web-page.

Paul - it sounds like you are talking about 'stock condition' surveys that we used to do on our Council Housing stock. These surveys may have been required under LGA or the Housing Act or the 'Decent Homes' standards, but I tend to agree with Ron, if those sort of scenarios don't apply then I would say 'good practice' for any property owner but not sure if statutory (other than duties such as asbestos etc that have already been referred to)

Don't forget that you need to also look at the fire condition of the building under the Regulatory Reform (Fire Safety) Order 2005. This includes the fire compartmentation of the building.
