Posted By HAC Can anyone help with some good examples of where employees have been prosecuted under HASAWA or associated Regs? Looking to spice up some training for some students who don't believe it would happen to them! Thanks H

Hi Paul I use these in my contractors’ induction Construction worker - 180 community service - Threw a bucket of concrete off scaffold - hitting workmate below (paralysed) Rail track worker 2 years imprisonment - Runaway vehicle 4 dead, the Manager was jailed for 7 years Maintenance electrician at an adventure park fined £2,500 + £500 cost. Young girl died when two carriages collided on the ride, safety device did not work Building Site Foreman fined £5,000 + £1000 cost, to be paid within 28 days or face 3 months imprisonment. Worker killed when dumper truck overturned Obviously I do not name the companies involved. More examples can be found on the HSE website and in the SHP, or HSW magazines Good luck! Ian

Posted By Bob Y As already suggested try the HSE site and narrow it down with a search for HASWA S7, S8 and S37 offences. Once you have the case you may then want to google to get more info

Posted By peter gotch H As Bob indicates + Section 36 (though one or two are corporate bodies causing others to be in breach) You can do single Advanced Search, then scroll down from default cases to breaches, then the Act, then each section and or button in between. Incidentally, the longish prison sentence was the boss, not the manager. Sentence for manslaughter rather than breach of HSWA. Employee got shorter sentence, ditto. Regards, Peter
