Posted By Merv Newman You should already have in place a general disciplinary procedure which may or may not specify some available penalties for "violations" This policy would cover H&S matters, without necessarily having to say so. If you don't have such a general procedure already in place then it probably won't help to try and put one in place just for H&S As for levels of penalty, I remember we all had a good laugh once when someone put up a photo of a list of cash penalties. About a dozen "violations" were listed with their "value" ie "not wearing gloves = 10cts", "not bowing to H&S person = 25cts" Merv

Posted By Philip McAleenan Violations do not occur in isolation, because workers want to hurt themselves or because they want to defy any instruction from the company, or some other such reason. Analyse the violations, determine what violations occur, why they occur and what alternatives there are. This I how you would approach an accident; not by setting an accident procedure accompanied by penalties. So why do this with PPE. Remember you have employed competent workers who are capable of understanding the requirements of their job. Talk to them and find out what their perspectives on the issues are. Philip

Posted By Andy Brazier There is a place for penalties for violations, but only if you are sure you have a 'just culture.' I'd suggest you have a good read of http://www.flightsafety.org/gain/just_culture.pdf

Posted By A Campbell You may need to look a little deeper and find out why violations are occurring. Could it be that the practice is now the norm due to managers turning a blind eye in the past? How often do managers conduct violations.... if they are doing this then the rest of their workforce are likely to follow suit? Just an idea of looking at the whole picture instead of individuals

Posted By Abaza What i exactly meant, that we have problems regarding safety violations on site so on one hand we are working on training and discovering why violations happen but on the other hand we want to have some kind of penalties to the workfore who intend to violate (interfering with safety equipments, not wearing ppe on purpose, smoking on site, violence, drugs...etc)
