A Law Lords ruling that Companies and Organisations cannot be sued by staff injured when using equipment not provided by their employer must leave a gaping hole in some legislation/s.
A chippy with a tool box filled with his and his company owned tools will now authomtically state that s/he was using the company chisel. Not my own M'Lud.
How is this one to be policed (I mean monitored)?

Difficult, but I can see European appeal being used and over-ruling this.
Which the law lords will not take kindly to.

I would like to read a copy of the ruling to see if there are any caveats. The Devil may or may not be in the detail.

I believe this particular case was highlighted recently on these forums. It seems a sensible decision by the Lords and may not have such far reaching implications as at first seems.
