Can someone who lives and works abroad be the named responsible person for H&S in the UK?

Hi all
One of my clients is a foreign company that has 14 workplaces and c50 employees in this country.
The employees in this country are not at a sufficiently high level in the organisation to be that named person.
Can one of the higher management, who lives and works abroad, be the named person?

While managerial responsibility might rest with someone in another country, who will have day-to-day control?

Yes, someone overseas can be the named person. Universities do it all the time - the Dean of Studies etc may be named as the person in charge for H&S in this country and they would then have to take into account any local considerations about the country where a student may be working etc for a risk assessment. In short, they have to ensure SFARP the H&S of the student/worker just as they do here. They would delegate to another competent person overseas just as happens here when they are not immediately available. Whichever country had the higher standard of H&S provision would IMHO be the expected standard in that event of having differences.
Have a look at section 5 in the following link for a bit of a list. I know this is not representative of work organisations but it is one which I knew of, having reviewed the H&S of very similar organisations for the same purposes in the past.
