Completely stumped on this one,
during a recent meeting to address running costs it was suggested that opening a window is far cheaper than whacking on the air con, I have now been approached by a lady who works in an open plan office who states that the windows being open are exasperating her hay fever, causing runny nose, itchy eyes etc etc and surely this is against the coshh regs.
Trouble is most of the other occupants of the office prefer the window open and the lady in question can not be found an alternative location and can not take anti-hystamines I believe due to other medication
my question, "does the company have to protect against the causes of hayfever and therfore insist on the windows being closed?"

COSHH is the control of substances hazardous to health and normally refers to something that the company is subjecting the employees to.
She would still have hay fever outside of work so is not something that the company has direct control over and is a medical condition. The person should return to her Dr for further advice.

Open windows is the answer but a little care as well - the employee may have chosen to work in an AC workplace due to asthma and although very weak it might make a mountain out of a mole hill if not dealt with properly.
The employee may also feel 'embarassed' that they are the only dissenter (but believe me there are times when I would like to live inside the fridge whilst others enjoy the UV).
If there are other issues around you could end up with a stress management problem.
I am 100% behind the 'green initiative' just need some sensitivity (pun intended).
