Afternoon to all
A question has been raised over a vehicle over 3.5ton, carrying a portable tank (bunded) capable of holding 1100 ltrs of gas oil,the tank itself is empty, however it has not been cleaned (purged).The question is would the vehicle & driver come under ADR requirements ?.

In short Yes ADR applies see 4.2.1.5 in ADR.
Empty portable tanks not cleaned and not gas free shall comply with the same provisions as portable tanks filled with the previous substance.

Thanks Dave for the response,
If the vehicle was under 3.5 tons would this then remove the full ADR requirements, my distant ADR experiences are failing me.

Nothing to do with the size of the vehicle its what you are carrying and whether its in scope or not.
