Posted By f5refresh I have tried the search facility but with no joy. So need your help asbestos experts. We currently have a licence to remove asbestos but I have found out today that we have a self employed contractor working and being paid through our company. He is competent to work and remove asbestos but my question is this, is he covered under our licence or will he need his own?? My initial thought is that he is covered by our licence to undertake asbestos removal work on behalf of our company - just need confirmation. Thanks in advance.

Posted By db Your best bet is to check with your ALPI. My guess is that the self-employed person needs to be classed as an employee for the purposes of the license. i.e. you ensure he has current training, face fit, medical etc.

Posted By Dave Wilson In licensed asbestos removal ALL the employees MUST be FULL TIME employees apart from site operatives. In essence must be on the books (Sups / managers) Ops can be borrowed from another licence holder OR hired from an Agency which has and asbestos licence. See ALG memo 6.05 on HSE website

Posted By db Are you sure that this person is self-employed? Under definitions set down by HMRC the true self-employed person would be in total control of the work, be able to sub-contract out the work to someone else, would need to provide all the materials and tools for the job and so would organise the skips, waste transfer etc. If the answer is no to the above, they are not truly self employed and should be treated as an employee.
