Posted By jmc Hi All The company currently ask for insurance, certificates, name of supervisor(person money is payed too). Should i ask for names of employees they are planning to use whilst working on our projects, emergency contact tel no for every operative they plan to use on our projects, (incase there is an accident on site) or is this the responsibility of the supervisor (person money is payed too)

Posted By claret65 I would consider your duties under Section 3 of HASAWA 74, in respect of other employees, but also realise the duties that self-employed have under the same Section. It's also relevant for you to consider your responsibilities under Section 2 of HASAWA 74, in respect of your own employees, when the self-employed are engaged in your workplace. That's the primary motivation for collating the information. Before issuing a contract, the best approach would be to consider the 'self-employed' as a contracting organisation engaged to provide a specific service for your organisation. This detail should be explained in a contract. That being the case a structured proforma could be issued, before engagement, to enable the self-employed to provide information in relation to: training and experience (especially previously completed contracts of a similar nature); liability insurance details ( including personal indemnity insurance); safety policy detail (if applicable)and organogram explaining internal responsibilities and contacts; resources( in terms of suitably qualified and experienced staff availability and developing staff like apprentices who maybe used); dependent on type of project:in date certification and inspection/maintenance documentation for plant and equipment to be used; administration detail (if necessary). Highlight responsibilities placed on self-employed to attend your organisation's induction process before starting work and to comply with your work procedures in place (this should form part of the contract). The main issues with external resource is how they interact with your own employees. Their work must be adequately controlled to ensure they do not affect the health and safety of staff. Whatever method you use to capture the information it must support this endeavor. However, as an organisation, you must not dictate the nature and method of the task they have been contracted to undertake. Unless the self-employed are to be integrated and used as an extension of staff.
