We have a few premises and have provided staff with covered smoking area (unually an open pagoda) away from our main premises. This is to allow them to be covered when they go outside for a smoke. I've now been told that these areas need to comply with the '50% rule'. This means they have to be 50% open to the elements. Does anyone know where this has been obtained from. I certainly did not find it in the regulations, but when I googled it some local authorities even showed typed of permissable shapes/structures.

It is in the Regs.
Smoke Free (Premises and enfoorcement) Regulations 2006. Reg. 2 Enclosed and Substantially Enclosed Premises.
See Reg 2(2)"which is less than half the area of the walls".
Basically the solid walls under a roof have to be less than half the perimeter area under that roof, the rest of area has to be open spsce. So to comply this should mean that the open areas under a roof should exceed the walled (solid)area. But rather than have 49.9999..solid to 50.000000..space, the 50:50 rule has been accepted in practise.
