A building constructed in 2002 is due for refurbishment. The H&S files material schedules indicate that NO ACMs were used during the construction process (as per the prohibition regs 1999). Does the client have to carry out a type 3 examination even though the risk assessment process has not identified the presence of ACMs

No Asbestos survey is required as you have good evidence to say that NO ACM's were used in the build!

Quite right. The code of practice L127 is now free to download, which says that if a property is built after I think 1999, then all you have to do is record the date of construction. Page 11 on the Acop once you have a look. For a SME business the same info is given on 8 steps to managing asbestos free leaflet.

The advice given by the HSE/ BOHS is that any building built or refurbished before 2000 may contain asbestos. A building constructed in 2002 will not require surveying.

11 By 1999 the new use of any building materials containing white asbestos had been banned. Therefore, an assessment of premises constructed after 1999 should be very easy. Unless you have information to the contrary, you would simply have to record the fact that the date of construction indicates there is no asbestos present.

Noting what has already been said [& very good too] you should still have an awareness and an emergency management system present just in case; as you never know because as recently as last year I know of a builder who tried to use stock that had been held a long time [asbestos roof sheets]on a job for an unsuspecting small client!
I would expect that other people have more asbestos stories
