We carry hazardous/WEEE waste on a waste transfer note to an outlet. The disposal point issues a consignment note which by the letter of the law makes the waste transfer note unnecessary and consequently either refuse to sign our carrier paperwork or want to charge for a signature.
My question(s) is:should the producer create the consignment note in which case the carrier does not need a waste transfer note, and without a signature from the disposal point, if the carrier was an intermediary, how would he prove he had not fly tipped?
To demonstrate duty of care should the disposal point not be obliged to sign for receipt free of charge?

The purpose of a WTN is to allow other people who handle your waste to know what they are dealing with so that they can manage it safely and properly Therefore you must create a WTN for each load of waste (the Producer) The producer must enter the relevant information on to the WTN to the waste e.g type, quantity, waste codes etc and where the site generates hazardous waste the site registration number See – www.netregs.gov.ukFor more information

Posted By Matt David Hazrdous waste should be transported under a consignment note not a waste transfer note. It sounds like both yourselves and the receiving site are both in breach of waste legislation as you should not transport hazardous waste without a consignment note and the receiving site should not accept the waste without a valid consignment note which they are duty bound to sign.
The premises from which the waste came from will also need to be registered as a hazardous waste producer if it is over the threshold weight.
This is assuming that you are located in England or Wales. For Scotland the Special Waste regs still apply.

Posted By Raymond Rapp Further to the previous post, the haulier should later provide a weighbridge ticket which will identify the destination, waste type and tonnage. This is evidence that the hazardous waste has been properly disposed of at a licenced site.

Posted By Dave Wilson Any haz waste you carry MUST be accompanied by a Hazardous Waste Consignment Note (HWCN) and all the issues you have alluded too are covered in this process.
it does not matter who raises it as long as it accompanies the waste.
section E of a single HWCN is the section dated and stamped at the waste facility.
This must be copied back to the 'producer' within 30 days of deposit.
