Hi all
Need a bit of advice on this one.
Our company carry out maintenance & new installation of heating systems for a Housing Executive. Each week we will do approx. 40 new heating systems, 150 dwellings for planned maintenance & approx. 200 emergency call outs. The Executive have an asbestos register of their housing stock most of which is not worth the effort of looking at as the information on it is minimal at best. I need to be able to give the operatives better information on where (if any) asbestos is located, this is ok for the new installation teams but with approx. 350 - 400 other dwellings being worked on by us there is no way of identifying asbestos in every dwelling, but on the other hand an operative may well be in contact with asbestos in every dwelling he enters. How far do i go.

Advise please.

My initial thougth when reading your post is have you carried out with your employees Asbestos Awareness training as per CAW 2006 s10? This is both a legal requirement and will assist those who come into contact with ACMs to identify a potentially dangerous occurrence.

It may also be prudent to ensure that where there is doubt and possibly some significant work taking place that you ensure the dwelling is suitably tested for ACMs. Whether you can recoup costs through the Housing Executive is another matter and one perhaps that needs to be agreed. You could also highlight to the aforementioned the quality of the asbestos register and reports. At the end of the day you need to protect your staff and insulate your business from any prosecution or civil claim.

In a nutshell, you have to be certain that your guys are not working upon asbestos materials. While the Housing Executive bear some responsibility to provide you with accurate information, you retain the ultimate responsibility to your staff and in all probability you will be prosecuted if things go wrong. Have a Google for Springfield school in Kettering for the possible fallout when this sort of job goes awry.

The Housing Executive really should pull their finger out and at least carry out a Typing survey of their stock followed by a representative asbestos survey of the identified types. Awareness training is very much the last line of defence and should not be relied upon. From the info you've supplied your company is wide open to claims, prosecution and of course exposure of your personnel. Be very careful.

If it is likely to be present (I.e. built before 2000) then you have to get the information. If they want invasive works undertaken, but only have the information from a non-invasive survey, then they must get the information for you i.e. perform the correct type of survey.

If in doubt don't do invasive work.

I also agree that your operatives should be trained. See the HSE pack for workmen recently put on their site.
