After any useful information on the following:
Background:-
As a company on the majority of our contracts we take on the role of Principle Contractor under CDM. We hire in mobile plant eg Excavators, Dozers, ADTs etc all complete with operators. I understand under various legislation we have duties to protect the health and safety of others eg the operators, with SSOW, Inductions, Safe place of work ect. But my questions are more concerned with how far those duties are with regards to the below questions.

Under The Control of Vibration at Work Regs i understand we have a certain amount of duties to control Whole body vibration to the said operators, but what level will their direct employers have eg should they be making assessments of the machines they are operating? Should their employers be carrying out assessments of the works and conditions on site eg haul road conditions ? With regards to health monitoring who has the duty to carry it out?

As far as I'm aware it is the duty of the employers where there is a requirement. From memory which isn't always the best I have a feeling that there is no suitable health surveillance from WBV but stand to be corrected.

Yul.

Until recently that was the case with regards to WBV there wasn't any clear dose response relationship.

The HSE have just issued a new Guidance document categorising certain types of plant into groups and the likely exposure to be found for the Quarry industry, the document also mentions health monitoring.

You are correct but the quarries guidance refers the reader to L141 where para 77 states that health surveillance for WBV is not appropriate.... but then para 78 suggests that health monitoring could be good but isn't a legal requirement. So I guess that monitoring for possible symptoms of WBV such as back pain is desirable but the presence of back pain may have nothing to do with WBV which might mean that people spend a lot of time and effort trying to fix something that isn't broken.

Yes, but who does the main of the duties fall on:-

Us as the PC,, as we are in affect putting the plant operators to work and thus it falls into part of our undertaking?

Or the Employer for all his duties towards his direct employees?

as per L141 there is no duty for health monitoring so no one is the clinical answer
