I am doing some work for a client who has some 150000 gallons of oil on his site at any one time. The oil is low fire risk, but I want to know when does the COMAH regulations apply? There seems to be some variations depending who you a sk. I have asked IOSH and HSE both have given me uncertain answers.
Can anyone help please thanks and kind regards

Hi,

Check with DEFRA. They have published a guidance document setting out the criteria to be used in deciding whether or not a major accident could result in significant effect upon the environment. Also it could depend on what they are doing with the oil. One example of operations covered by COMAH includes: Distillation or refining or other processing of petroleum or petroleum products. For an operation to require COMAH approval it must also use one or more of the following substances: very toxic, other toxic, flammable-gases & liquids as specified, explosive,oxidising, or quantities above a minimum threshold for a range of individually listed substances, so check the list in the regs.

Following an ammendment to the COMAH regs in 2005 a special named category for petroleum products was introduced to cover the fact that many petroleum products are both flammable and environmentally hazardous.
There are 3 groups within this category Gasolines, Kerosenes and Gas oil (which includes heating oil and diesel fuel). Threshold quantities for lower tier are 2500 tonnes and for higher tier 25000 tonnes.
If we assume that the oil on your clients site falls into the gas oil category then by virtue of the volume stored the site would not be a COMAH site.
If you can't classify the oil as a petroleum product then let me know and I'll guide you through the the generic assessment process.
