Can anyone clarify whether a CDMC can be employed by the Principal Contractor on a project or is it always policy to be contracted directly to the Client? What would be the legal ramifications if employment via the PC?

It's the clients duty to appoint and if there isn't one appointed they have a duty to highlight this to the client. In theory there is no reason why the CDMC cannot be sourced by the PC but I would suggest that for obvious reasons its not a good idea.
All good in theory but it would seem that you are finding out that in the real world it doesn't work that well on the majority of projects

I wouldn't recommend a PC employing a CDMC. Thats not to say it can't work well, however I have experience of being called in to investigate a major accident by the client on a CDM project where a CDMC had directly employed the CDMC....the client was having major problems finding out just what the causes were. The CDMC subsequently found himself in a difficult position, both morally and pesonally.....like everything else I suppose you're alright until your not

sorry that should have read - where a PC had dirctly employed the CDMC
