Have you read through TG20 08 guidance, this has information regarding inspections and testing that ought to be carried out.

Hi, I think that scaffolding should be inspected by a competent person before first use (hand over certificate) and subsequently after any substantial addition, dismantling or alteration or event likely to affect strength/stability such as adverse weather and at regular intervals not exceeding 7 days since last inspection. Inspection reports should include location of place inspected, description, date, time, identified faults, action taken to remedy, further action necessary, name and position of person making the report and reports to be kept on site. Barriers/notices should be put in place to prevent access if the scaffold is found to be unsafe to use and until any fault has been remedied. Steve

Scaff tag is certainly best practice but as long as an inspection has taken place and it is in safe condition and the report is kept in a safe place, i believe there is no legal requirment for a scaff tag. Might be different if the scaffold ISN'T in safe condition though.
