Can anyone help with this query.

Is it a legal requirement to have a dumb waiter installed, if within a restaurant the kitchen is on the first floor and restaurant is on the the second floor, and food would need to be taken up and down stairs if one was not installed.

No, it's not a legal requirement, but you need to think about how you intend to manage the risks involved with people repeatedly walking up and down stairs, possible spillages and resultant slips and falls. Are these stairs for the use of staff only or do the customers also use them? Are there doors at the top and bottom? Also it would mean staff using both hands to carry the food and having no hand free to use a handrail.

My local McDonald's certainly doesn't offer me that option should I choose to use the upstairs section!
