Hi All Does anybody know whether the Lifts Regulations 1997 are revoked under LOLER or the Machinery Regs? I have looked at both and am unable to get a definative answer thanks robin

Supply of Machinery regs slightly amended them I thought http://www.opsi.gov.uk/s...uksi_20081597_en_12#sch6 but I am not aware of the lift regs having been revoked yet have been wrong before(and no doubt will be again) cheers Martin

Hi Robin I'm not UK based but it doesn't seem to be revoked because Lift Reg 1997 is specifically for lifts while Machinery Reg includes all types of machinery and deals more or less with the CE Marking, while LOLER applies for all lifting operations including the equipment used for lifting. So by deduction, although there may be some overlapping of principle, the scope of each regulation is different; therefore neither LOLER nor Machinery Reg may revoke it. In my appreciation these two regulations are different and cannot revoke the Lift Reg 1997. I'm sure somebody will confirm this, unless there is another regulation where it has been revoked, which i'm not aware of. thanks Vrick

Robin A quick look on the HSE site gave me this http://www.hse.gov.uk/pubns/indg339.pdf While I an no lift expert is seams to suggest that the Lift Regulations 1997 apply to New Lifts while the LOLER requirements for thorough examination takes over after installed (see page 3). So clearly LOLER did not repeal them. Hope that helps. Brian

Robin, I can confirm that the lift regs 1997 are still valid and in current use. Any newly installed equipment should be installed to BSEN81 1 or 2 depending upon its drive ie Traction or Hydraulic. This then leads to further Standards for emergency communication and fire fighting provision. Although none of this is relevent if the lift is classified under the Machinery Directive. A very grey area in the lift world - what defines a lift ? A rule of thumb if you need to keep constant depression on a button for the lift to move then refer to the machinery directive, if not then its a lift and must comply to EN81. All lift shoild be examined to BS8486. Hope this helps. Chris

I would imagine that the lift regs will still apply as they apply specifically to lifts and there is no distinction in the lift regs that I am aware of between lifts used in the workplace or lifts provided solely for use by the general public. If lifts are used as part of the workplace then sections of the LOLER Regs do come into play. If the lifts are for use exclusivley for members of the public LOLER Regs will not apply and therefore they would not be able to revoke or supercede the lifts regulations. I think !

LOLER, PUWER, Lift Regs 97,EN81, etc..................................All are relevent where lifts are concerned regardless of who is using them. Different codes and standards are used depending on the lift design / if is a refubishment / End requirements. The only time all of this becomes almost irrelevant is if the lift is installed in a private house for private use only. Chris

Robin, these Regulations are required in the UK to specifically implement the EU Lift Directive 95/16/EC. As a member state, we'd be in big trouble if we withdrew or revoked these Regs! There is a new Machinery Directive though, and that came into effect 29th December 2009.
