I would like to put a scenario and canvas some opinion please.
On a lot of retail sites you have mansafe systems on the roof, they often cover three, four or five different shops. If we accept the mansafe system as the safest practible way of securing yourself then obviously it should be certificated and used.
1. Who has ultimate responsibility for the thorough examination of the mansafe system? 2. If we accept the landlord is responsible how do we ensure he has used competent contractors to certificate it? 3. Does the landlord have a legal duty to supply proof of the mansafe systems thorough examination. 4. Do people actually believe mansafe systems are the safest practicable way of securing oneself on the roof as opposed to things like attaching to the MEWP or the roof?

1 - the duty holder, tenant or indeed the landlord - depends on the lease e.g. occupier full maintenance agreement - if the man-safe may comes under this agreement - you would need to check
2 - check the certificates and competence of the party undertaking the examination - easy if its a reputable Insurance company - the landlord has the responsibility to ensure this is done by competent persons and if they have many premises it will most likely be an insurer
3 - yes if he's the duty holder - why wouldn't he supply you proof he's employing you and sending you up there - he has a duty to provide you with this information
4 - good one - risk assessment my friend and consider all factors and there are many - I personally would not except it’s the safest means without a thorough risk assessment of the task at hand - consideration has to be given to the capabilities of the system to include its accessibility to the required points on the roof you need to get to do your job. We cant simply say we have a man-safe its been examined - clip on and off we go.
Do not underestimate the size and the challenge of the scenario you have presented here - the variables are large given lease agreements, the man-safes fitted and communication required by what could be many parties.
Another scenario to add to yours - If you have a single man-safe over several properties and all the tenants have full repair leases with the landlord which includes the maintenance of the man-safe - it’s a good bet we wont be excepting that man-safes are the safest method because it a good bet it wont be inspected for use.

- All man safe systems require an annual check. This is usually carried out by the original installer who acts as an agent for the manufacture of the system. Man Safe is a generic term used for a horizontal cable system though is the trade name of Latchways. There are many types on the market but all should have an attached tag at the point of entry which will describe the number of users and if it is a Fall Arrest system or Restraint.
-Systems are often checked by insurance companies but ideally they should have had training from the manufacturer to carry out this check.
-Leaving the basket of the MEWP and using it as an anchor point is potentially dangerous, one of the many reasons is that the resultant forces may exceed the anchor strength/capabilities of the MEWP.
-The design of Man-Safe systems varies . Pre installation the installer may offer various designs to the client. For example a perimeter system on a building 2 meters in from the edge for use in restraint with fixed length lanyards. However costs may mean that the design is changed to a ridge line system where adjustable restraint lanyards are required. There is always the possibility when using a system for human error to occur, so in answer to your question they are not always the safest.
Also don't forget that the users should be trained in Working at Height.
