Morning All
I'm looking for an old piece of case law that helps to define the responsibilities of the placement provider and the employer along the lines of their duty of care.
I can remember referring to it when I worked for Lincolnshire TEC but my memory is failing and I can't find it (just when I need it) to support some advice I'm giving.
I think it referred to an accident to a YTS participant and the role of the placement organiser who tried to shift all the blame onto the employer.
Anyone remember it or give me an idea where I can find it - thanks!

Hmmm .. 100 views and no replies.
Presumably this means my old TEC pals are comfortably retired.

I am sure you know anyway and I apologise if its teaching you to suck eggs time:
Both organisations are employers, although they do different work activities, and the actual safety requirements might differ, but both have the same statutory duties under HASAWA Section 3(1) and if they employee a trainee under HASAWA Section 2(1).
So case law from your YTS days is not strictly necessary for you. Understanding and complying with the HASAWA and Regulations is.
By the way you are showing some age with YTS!
