As long as they are appointed by the Client, are competent to undertake the role and of course there is no risk of any incestuous activity.

It is debateable whether the last item is a legal requirement, desirable definitely. The first two certainly are. Bob

"Incestuous"????? Anyhoo.............remember that in the absence of appointment, the duty falls to the Client.

Yes they can, the CDM co-ordinator is a person or persons, the principle contractor is a company. The CDM co-ordinater can be employed by the principal contractor as long as they are appointed by the client and are competent.

That's a rather odd distinction you make there, Neil - and an incorrect one. Nothing in law says a CDM-C has to be an individual. Moreover, the legal definition of "person" includes both individuals and bodies corporate. This is an important definition to appreciate for those of us engaged by employers (either individually or as part of another organisation) to satisfy Regulation 7 of the Management Regs.

Ron fully with you on this and in fact I think the HSE always do prefer to see the appointment as a corporate one. I think most posters know my intense dislike of individuals as CDMC anyway. Bob

Horses for Courses with me, Bob. On a straightforward Notifiable Project, I've no issue with one person seeing the Project through in CDM-C capacity. On more complex Projects, there has to be recognition that it is unlikely one individual covers all the unusual risk areas. That said, over and above any individual role, I would always stress that CDM requires a true "team" approach by all duty holders.
