Here's an interesing case;Last year (27/01/10) an employee of ours reported that he had fallen over while doing survey work in field in Cornwall. He was injured and in some pain, but after a few days rest seemed to recover. He did not visit a medic or anything and was not off work for more than 3 days. So at this stage this was not a RIDDOR.
He recently had a medical which included an X-ray and it looks like he has a fracture of his hip, which could be down to his fall.
So do we need to report it and what happens if they ask us why it has taken nearly a year to report it?

I am not convinced that I would report it, although not sure if I would strongly against reporting it either; on balance - not.
If you do report it and they ask why the delay, then use the explanation that you have already alluded to in your post.

Personally I would request Med Records to try and establish if the fracture was actually 11 months old - this should be confirmed by the GPs notes, X Ray via the healing process.
If that’s the case report it - its perfectly reasonable why you did not in the first instance. Over 2 years is my record!
requesting the MR's as part of the investigation will assist two fold also - you may well get a PIC - if any injury has been aggravated by such a long spell between diagnosis, this will support any defence - I appreciate this is a bit negative and may not apply but I am seeing a massive increase in PI's, so I always take this type of action.

I decided to ask our friendly local HSE Inspector whether we should report this and he said "based on the information supplied" that as there is no clear evidence that the fracture was caused by a work activity we need not report it!
A turn up there-so reasonable so as to be shocking.
