Hi all
Would ask your advice please on the following, although not strictly a H&S issue. We have been approached by a company telling us we could save X amount a year by using red diesel in our two forklift trucks. We travel less than 1000yrds between our two building daily at least 3-4 times a day. Everything that I have found tells me not to use it although the company are saying we would be ok. Everything I have read tells me that if the journey between the buildings is regular then red diesel cannot be used. Has anyone else come up against this before. I am holding out on this because it does not feel right to me. I have two directors wanting to save the cash but I am fully aware that once that red diesel goes in the tank it will always register if tested by the Police or Customs and Excise.

Any help greatly appreciated.

Assume you take the advice of one of the many barrack room lawyers you are quick to quote - and interpret - matters of law in the most convincing ex-Cathedra style.

Now assume that you get a visit, and have your collar felt. Who do you point to? Someone hiding behind a cryptic non de plume, or even someone not hiding and prepared to identify themselves fully?

Either way, it really doesn't matter - it's you who are in the frame!

But the answer is in the question. You know that it's a question for HMRC. Ask them. They will give you a definitive answer and you will be in the clear. And if the advice of your 'supplier' is wrong, I'm sure they will be pleased to hear about them.

hi we run 2 fork lift trucks in scotland and they run on red diesel and travel on the main highway over 5000 mtrs .they must have full lights and road tax £15.00
