Hi all, Can you please provide some steering as to whether the following would be our responsibility or that of the providers. We organise basketball games for a number young children who are residents with their families in a number of our general needs properties. The basket ball games are held in the hall of a state school and are organised and run by a professional local basket ball team. A representative from the basket ball team manages the entire event. A few of the children have sustained minor bumps and cuts as part of the activity. Can i seek clarity on whom the responsibility would be on to ensure incidents are reported/recorded? Thanks Abs

Hi there, My thoughts below: If the children are your service users as part of work and business of social housing or similar, you should record any incidents in your own records and investigate them as you have a duty under HSWA 1974 Section 3 to take all reasonable steps to ensure the safety of non-employees. The incidents should also go into the sports hall's records as it is the premises on which the accidents occurred. Bumps etc are minor injuries as you said and not reportable under RIDDOR. If you did have a riddor reportable incident (in this case the children would probably be considered members of the public, so if they went directly to hospital from the sports hall it would become reportable) then RIDDOR Table 1 in L73 guidance states it should be the person in control of the premises during the time of the accident/event where the activities are taking place who should report it. Professional sports injuries (not the children obviously) from physical injury in general do not fall under RIDDOR. The main issue here, is someone must ensure it is reported and if one party doesnt report it, you should report it. Ensure efforts are coordinated and confirm through RIDDOR Reference number that it has been reported and there is no duplication of reporting. Hope this helps. Mubin
