Hi all
is a golf club committee - being decision makers on certain things and finance etc, responsibile for health and safety issues or failures? the committee are of course all voted in and the highest ranking employee is the Secretary Manager of the club who has the responsibilitiy to action and manger/oversee. Can anyone let me know if in certain circumstances they would be held responsible?? The club is owned by the members.

The short answer is yes.... probably.
The Greenkeepers Training Committee (GTC) have produced a guidance document on the subject ("Health and Safety in Golf Course Management and Maintenance"), and this might be worth a look ?

Whoever is in charge of the club i.e. Board, Committee, etc, they are responsible for the health, safety and welfare of staff, guests and visitors. The General Manager/Secretary will have day-to-day responsibilities but should be directed by the those in charge.
In reality if there should be a serious h&s failings, it is most likely the golf club would be prosecuted as opposed to any individual(s).

If the Golf Club is incorporated - ie it is a Ltd company then it is a legal person and the committee members are officers of the company. You say there is an employee, then HSWA applies. The Ltd company is the main dutyholder. In the event of a civil claim the Ltd will be the defendant. If the Golf Club is unincorporated and run by an elected committee then the legal responsibility lies with the committee as a group or as individuals. Again if the club has an employee then the HSWA applies. The employer is the Club but it only has a legal personality through the members of the committee. In the event of a civil claim or criminal prosecution the committee can be prosecuted/sued as individuals.
