Hi All, 

I am wondering if the IOSH community could offer some guidance.  

I have recently been invited to travel to Paris to meet with a design team who will shortly be traveling over to England to assist with some design work on a construction project.   The client has requested that we provide a brief presentation to the French designer team to discuss the duties placed on designers under of CDM 2015 and also offer a brief general overview.

After doing some research I have a basic understanding of French safety legislation but am struggling to gain an understanding of how CDM (or the equivalent of) is applied in France.  Ideally, I would like to be able to show some comparisons of how they do it in France and how we do it in England, hopefully finding some common ground. After some digging, I have found an HSE document (CRR 84/1996) which does make refence, but this is obviously outdated.

As CDM derives from EU directive for temporary or Mobile Construction Sites (TMCS) Directive I am hoping we can find common ground between the two?

Any guidance would be very much appreciated.

You can find what French legislation is deemed to implement the directive at https://eur-lex.europa.e...dvanced-search-form.html

Do a search to find the directive (so, e.g. 'temporary mobile construction' in the title).  When it finds the directive click that result to take you to the text of the directive and in a box on the left hand side of the screen you should find 'National transposition' which will tell you how each country has implemented it.

I doubt this is actually useful though - it gives you a load of French references, and you can judge how likely it is that's going to be useful by looking at what eur-lex gives you for the UK - various regs back to 1961 and every version of the CDM regs, i.e. probably not what you'd want to start from in reverse (if you were French wondering how the UK implemented the directive).

You might also need to consider how the Framework Directive 89/391/EEC has been implemented in France as this is the parent to the Daughter Directive, TMCSD.

The Framework Directive is also the source of most requirements for risk assessment.

You can download a Non-Binding Guide to TMCSD from the EU bookshop for free. This might help establish what the French designers see as being common with the transposition of TMCSD in France with what's in the relevant parts of CDM that does more than simply transpose the Directive, not least as CDM reenacts previous legislative requirements in Great Britain.
