Hi All,

Does anybody have any case law concerning prosecutions for failing to report, or investigate an Adverse Event?

Looking for Case Studies for a training package.

Have you tried the prosecutions website?  You can search for failure to report under RIDDOR

I can’t imagine the HSE bothering to prosecute simply for failing to report a RIDDOR. By the time the HSE feels it’s worth prosecuting the defendant would have had to have a gross Health and Safety failure not just a technical one. They might throw in failing to report as a bonus but in reality it would be something more fundamental like failing to have a suitable and sufficient risk assessment or just not ensuring the Health and Safety etc of their employees.
