Hi, could somebody please clarify when asbestos in textured ceiling paint was banned. Some people suggest 93 and others 99. I have moved into a house built late 2000/early 2001. The ceilings are textured and cracked. If the ban date is 99, would it be likely the builder would still have stocks from 99? It was a large homebuilding company (Bryant Homes).

Supposedly the ban on white asbestos started in 1999 following blue and brown in 1985. You should be able to presume a 2000/2001 build will have been asbestos free. But as you consider has someone used up old paint stock? Only an analysis will determine what has happened but a report will be a good basis to determine further action.

If you do decide to have it sampled, ask for more than one sample to be taken, due to the mixing for textured coating it will not be uniform across the ceilings if present, so you can have a negative sample on a positive ceiling.

If everybody followed regulations there would be no prosecutions or product recalls both of which still happen.

Not sure how reliable these various websites are. A lot of contradictory info about. The 92 regulations seem to ban chrysotile containing textured coatings: https://www.legislation.gov.uk/uksi/1992/3067/contents/made

I will email the HSE and pick their brains.

Good luck with HSE .... and yes Craig 1992 was the date of prohibition. For something like a house - then if the whole place is coverd with TC and it was built after 1992 then likely to be non asbestos. If its one room then unless it was later then worth getting it tested. All to do with how much textrued coating you need. It is perfectely possible that 1 room could have been done out of an old bag of TC. A whole house would need quite a lot so more likely to have been purchased from a builder merchant and be non asbestos.

Thanks - it is the whole house. Every house on the estate is the same.

I also received this reply from the HSE:

Asbestos (ie chrysotile) containing textured coatings (sometimes referred to as decorative coatings or by their trade names eg ‘Artex’ and ‘Wondertex’) were commonly used in domestic and commercial buildings up until 1992. The use of asbestos in this type of product was prohibited by EU and UK legislation (Asbestos (Prohibition) Regulations, 1992) after this date. The 1992 Regulations prohibited the supply and use of chrysotile containing products specified in the schedule. The list included decorative finishes and decorative products in powder form. Therefore textured coatings in properties constructed or refurbished after around 1992 should not contain asbestos. Their use was actually diminishing well before that date. Artex containing textured coatings started to be phased out in the mid to late 1980s and were replaced by non-asbestos versions which had been available from the around the mid 1970s.
