Can a load guard be removed from a fork truck if a specific documented risk assessment, method statement and lifting plan justifies the removal and an alternative safe system of work is adopted?

For clarification, by "load guard" are we talking about the back rest?

If so, I would give a tentative yes. I know that the back rest is an "optional extra" when purchasing a forklift, suggesting they are not a necessity.

However, the removal of such may invalidate the CE mark, since it is a change to the machine and you may need to seek re-certification.

Guessing you have a specific guard or task in mind.  Perhaps if we had an idea as to what guard was reoved then an answer may be more relevant.  In general I'd prefer to be looking at how we can modify the lift rather than modify the lifting equipment
