Its the same problem Do we report it or not

The IP has a history of back problems, but sayes they are okay to work and fit note from a GP

then goes sick for 2 weeks sayes its ill health but has now 2 1/2 weeks later said it was an accident as the work he was doing made his back go later inteh evening when he got home

so no incident at work, no report of an inury

RIDDOR  or not???

Not RIDDOR as there was no accident in work.

Not reportable - no single accident created the issue

As above, not reportable.

From the HSE "RIDDOR Key Definitions" page https://www.hse.gov.uk/riddor/key-definitions.htm

"injuries themselves, eg ‘feeling a sharp twinge’, are not accidents. There must be an identifiable external event that causes the injury, eg a falling object striking someone. Cumulative exposures to hazards, which eventually cause injury (eg repetitive lifting), are not classed as ‘accidents’ under RIDDOR."

As always, with the caveat that of course you would still be expected to do some investigation into the injury to ensure you are doing all that is reasonably practicable to prevent these sorts of injuries.
