Hi all, am I right that a new pneumatic lifter falls under the CE marking/machinery directive and therefore requires a declaration of conformity? I'm just trying to decide whether it requires a thorough examination (before first use) or not; if it has a DoC and since it's less than year old, I assume that it doesn't? I've only just found out that we have this new one, so I want to be sure that if it requires one, that we have the DoC and if we don't, that we have the TE done. Thanks.

If it can be used “straight out of the box” then it must have a DoC.
If it requires integrating into something else, then it may come with a DoI and the integrator is then responsible for CE marking the assembly and thus providing the DoC, which would include final load testing in accordance with MD requirements which would be required to legitimately CE mark the equipment for use.
LOLER would then follow by the end user once required.
This would rely on the CE marking being present though.

Yes it can be used "straight out of the box" and does have a DoC. So again, I assume with it being new and having a DoC that it doesn't require a "before first use" TE? Thanks.

I'm going to have to disagree on it requiring a TE unless it more than 12 months old as LOLER say: "Regulation 9 states: (1) Every employer shall ensure that before lifting equipment is put into service for the first time by him it is thoroughly examined for any defect unless either – (a) the lifting equipment has not been used before; and (b) in the case of lifting equipment for which an EC declaration of conformity could or (in the case of a declaration under the Lift Regulations 1997) should have been drawn up, the employer has received such declaration made not more than 12 months before the lifting equipment is put into service;"

Yes but it can be used straight out of the box; you literally make a few connections and away it goes, so that doesn't count? It's not got any assembly as such.

In which case it requires a Declaration of Conformity from the integrator which will require a load test in accordance with the product standard/EHSR's which puts it into the exempt from LOLER requirements again.
