My employer recently opened a new office which I attended to carry out a FRA. I'm trained to carry out FRA's in accordance with PAS79 and used the Home Office guide for Fire Safety Risk Assessment in Offices, as the primary source of information. The HO clearly explained the requirements for fire doors, extinguishers, singage, travel distances etc for office environments. 

There were several findings requiring corrective action, some of which, I felt were the Landlords responsibility:

  • A fire exit keep clear sign is required on the outside of the final exit at the rear of the office. On the otherside of this door is an operational farm yard, so it is foreseeable that at some point, equipment or materials may be placed in this area. 
  • The fire doors fitted to the kitchens and protected escape route do not have intumescent strips or cold smoke seals fitted. 
  • There are no fire action notices displayed. FAN’s should be displayed above all manual call points.
  • All escape route signage is fixed on the doors. In accordance with the Home Office Fire Safety Risk Assessment Guide for Offices, escape signs should be fixed above the door in the direction of escape and not be fixed to doors, as they will not be visible if the door is open. It is recommended that existing escape signs are removed from the doors and fixed above the doors. Note - the signage currently stuck on the doors has already started to peel. 

The Landlord responsded as follows: We have only just refurbished the part of the building you rent and it was subject to building regs which we had signed off including all fire related issues so we have met our obligations. Indeed part of the snagging in this regard was signage which is placed as demanded. We also have an annual review of our Fire processes by our H&S advisors and inspections on occasion by the fire service, neither of which have asked for any of the remediations you have. Indeed one of our other tenants has just been audited on ISO proceedures including fire and what we supplied them passed audit with flying colours. I consider we have met our obligations with regards Fire Safety therefore. I will raise you points at our audit as if there are actions required we will do so across the whole building.

Do you feel that my findings from the RA are fair and should I insist the Landlord addresses them? Your advice and guidance will be much appreciated.

Clearly they are not interested in your findings (which look uncontentious to me) and I don't see that you have any power to insist that they address them, so I fear you are on to a loser here.

I would be very careful how to proceed as sometimes its worth picking your 'fights' 

Out of the list you have supplied, I would suggest that the strips and seals on the kitchen doors may be the most relevant and only then if the risk is the kitchen is high (full cooking appliances rather than a simple tea point) or they are located on a single staircase or dead end means of escape.

The requirement of the FSO is to record the significant findings. I would argue that some on your list do not meet that criteria.

We do not display fire action notices by all manual call points. There is no legal requirement to do so and its vital to separate legal obligations from guidance. But we do display FANs at in kitchens and on the back of toilet cubicle doors. The rationale being peole have more time to read them in these locations than in a corridor 

So perhaps push the kitchen doors if you think the risk requires it, and formally write to the landlord and any other occupiers of the building listing your findings, highlighting that no action will be taken by the landlord and that you are sharing this info for their information & in compliance with Article 22 of the FSO

Lastly, share you concerns with your staff. Point out the location of the alternative rear exit and that they should report any issues where agricultral equipment is found obstructing the MOE. And make up your own fire action notices
