Site is owned by landlord.

Landlord rents site on term-term lease to tenant.

Tenant builds produciton facility on ground

Tenant employ PC & PD to design & build the facility - PC employ their own EHS team

PD employ comissioning team to ensure facility works as requested by tenant

Tennnt employ O&M team to run site for next 15 / 20 years - they employe EHS manager

There is an overlap of 12 to 18 months with PC running site with PD / O&M employed on site as sub-contractors.

PC refuses to share H&S file until they leave site 

O&M concerned that H&S file will not contain suitable records / advice (no SWL on cranes - even thoug hthey are in use; only some confined spaces identified / labelled) 

My question (after all that) is - should the the O&M team have access to the H&S file prior to the end of contract so that anything "missing" can be identified and resolved?

Can the O&M team refuss to work on equipment / site that is not yet completed / considered not fit for purpose?

How have others resolved the above scenarios?

Your question could be an exam question and one that could take several pages to answer!!

Personally I don't consider that e.g. the SWL of an overhead crane should be in a CDM Health and Safety File, but rather be in Operations and Maintenance Manuals though possibly with cross-reference between the HSF and O&M Manuals.

For many projects, there should be more than one HSF, as there are likely to be multiple structures as defined in CDM.

But the Regulations point to the purpose of the HSF being about future construction work, also as defined.

So, taking your overhead crane as an example, its purpose will rarely, if ever, be for construction work

This is a not untypical scenario where there is a strong argument for progressive handover of HSF(s) and O&M Manual(s).

Of course the O&M people can refuse to work but this may come at a financial cost.

So, this is about making sure that Contracts say what is to be provided for the purposes of CDM and its parent legislation and when.

Timely delivery of the HSF(s) has probably been the greatest single problem with CDM since its first 1994 iteration.

The H&S File is the responsibility of the Principal Designer.

All contractors have a duty to provide relevant information to the PD for including in the File.

It is usually up to the PC to collect the information from all others but in my experience it is the worst job in the world trying to get sub contractors to provide their documents.

I usually do what I can and send the info to the PD and let them know if I receive any more I will forward them on.

To add to the above.

I start collecting documents as the project progresses, looking at the programme it is not too difficult and the work is fresh in the minds of the contractors.  I keep hold of that info until I have it all or until the PD requires it.  If required earlier than that I can send what I have.  No point at all in me keeping hold of it.

 I get paid when I have sent it ha ha.
