Is it a legal requiremnet and ultimate duty of care for a company to carry out health surveillance on forklift drivers.  I am led to believe that you need to carry out fit to drive at 45 years of age and every 5 years therafter until age 65 and then it must be every year.  Is this correct?  

Note : Some employees drive on the public road

Sounds like you are confusing PSV / lorry road licencing requirements with FLT's and health checks

https://www.gov.uk/employing-people-to-drive

The standard UK road licence held by most drivers does not mandate health checks but does require declaration from 70 onwards in a three year renewal.

I have come across this before on larger Fork trucks and what they are doing. I’m sure it was on the DVLA site in the past, but a quick search got me here which indicates similar with caveats.

there is no legislation mandating medical fitness to drive for FLT drivers...it is considered best practice, and the assessment would align to that of DVLA medical standard but there is also some construction industry guidance that classes them as safety critical operators and subject to slightly more rigorous medical...

It is common practice to do this but not a legal requirement.

I would concur the desire for a "certificate" of driver assessment aka an FLT licence is common

I would also concur that some form of "refresher" training (3 or 5 years) is common (but less so) and again more from best practice guidance than legal requirement.

From personal experience over many years & sectors health assessment of FLT drivers appears uncommon.

In my experience it is not common practice to have FLT operators undergo health surveillance. Initial training and refresher training along with supervision and monitoring to confirm compliance is what I believe common practice to be.
